In Nakara's case, the five-judge bench of the Supreme Court, on 17.12.1982, ensured equal pension for all regardless of their retirement date, and made pension a statutory right. Indira Gandhi implemented the judgment without appeal. The Modi Govt appealed the CAT award of pension revision after the expiry of all time limits. It challenged, spending crores of public money, the Army Tribunal's award of pension to the disabled soldiers. In March '25, it passed Validation Act was passed to negate pension benefits to the existing pensioners. In the ToR of the 8th CPC, it didn't mention pension revision. It said that the central cabinet would decide the date of its effect. All these violate Nakara's judgment and the Constitution of India.
